General Terms
The following general terms and conditions apply to the treatment agreement agreed upon with you.
1. Treatments and Appointments
- The manner in which the treatments will be administered and the procedures to be performed will always be discussed with you. A treatment plan and treatment agreement will be drawn up in consultation with you. The patient will sign the treatment plan and treatment agreement. The patient will receive a copy digitally or on paper.
- Treatments will be carried out in accordance with the treatment plan and treatment agreement.
- Treatments are by appointment only.
- Appointments can be made by telephone, email, or at our location in Lisse.
- During treatments, the spinal column must be visualized. Female patients will therefore be asked to wear a treatment gown.
2. Administration
- We expect you to inform us as soon as possible of any changes regarding your health, medication use, address, insurance, or other relevant information, to ensure that our institute has up-to-date and accurate health information prior to each treatment. Our institute or its practitioners are not liable for any damages resulting from the patient's failure to provide this information, unless the inaccuracy or incompleteness should have been apparent to our institute.
- You are responsible for keeping your personal data up to date so that we can contact you if necessary.
3. Fees and Payments
Our institute reserves the right to change its fees annually. Fees can be found on our fee list at the institute's reception desk.
- Specialist 1st consultation incl. Neuro Diagnostic Testing €500.
- Standard (Chiropractic) 1st consultation excl. Diagnostic Testing €200
- Three-week treatment program, two treatments per week, plus any additional costs such as diagnostic tests €210 per treatment
- Three-day treatment program, two treatments per day per half-day, plus any additional costs such as diagnostic tests €210 per treatment.
- Five-day treatment program, two treatments per day per half-day, plus any additional costs such as diagnostic tests €210 per treatment
- Neurodiagnostic test €35
- Preparation of medical report €225
- Introductory Zoom/Teams consultation (20 minutes) €55
- Supplementary rates available upon request
- HBOT oxygen therapy €375 per 90/120-minute session
4. You will generally be billed at the end of your visit to our institute. Payments can only be made by debit card.
5. You are responsible for your health insurance and therefore for coverage of our services.
6. Our institute reserves the right to charge fees for various services outside the treatment plan.
7. Invoices must be paid within the specified timeframe. If (full) payment is not received after reminders and notices, our institute reserves the right to outsource the collection. In that case, you will be responsible for the statutory late payment interest and additional (collection) costs. The collection costs amount to 15% of the outstanding amount, with a minimum of €40.
8. Our institute is entitled to suspend services until full payment has been made.
9. Cancellations
1. Appointments or treatments can be canceled or rescheduled free of charge, provided that a request is made by phone or in person at least 48 hours in advance.
2. If an appointment is not kept or not canceled on time, the full fee for the relevant appointment and/or treatment may be charged. Our institute will decide whether force majeure applies and whether an exception is possible. Our records serve as proof of the appointment, unless proven otherwise. Please note that your health insurance company may not reimburse a claim for a no-show.
3. For multi-day treatment programs, our institute must reserve time. In the event of late cancellation or premature termination, we can no longer use the reserved time commercially in our weekly schedule. Therefore, in the event of late cancellation or premature termination of the multi-day treatment program, we will charge the full costs of the treatment process.
4. Our institute reserves the right to reschedule your appointment. We will discuss this with you in a timely manner.
5. An appointment or treatment can always be terminated by mutual consent.
10. Privacy and personal data
1. As part of the treatment agreement, we require your personal data. This data is stored in an automated system and is, of course, processed confidentially and in accordance with applicable privacy legislation. The data is used to carry out the treatment order and for relationship management. We may also use this data to inform you about other services provided by our office. If you do not wish to receive this information, please inform our institute.
2. To the extent our institute uses suppliers for part of our administrative tasks, we have data processing agreements in place with these suppliers to protect the data. We only share your data with third parties with your explicit consent, unless the sharing is required by law.
3. Our privacy statement describes exactly how we handle your personal data. You will find this statement attached.
4. Making video and/or audio recordings is prohibited in our institute. This applies to both our outdoor area and inside our building.
5. Retention period: Patient files are retained for a period of 20 years, as recommended by the SCN.
11. Liability
1. Our institute's liability for damages arising from or related to an attributable shortcoming or unlawful act, or on any other legal basis, is in any case limited to the amount paid or to be paid by our institute's (professional) liability insurer in this regard, plus its deductible under that insurance, unless there is intent or gross negligence.
2. All patient claims expire twelve months after the date the data subject became aware or could reasonably have been aware of the existence of these rights of action or other rights or powers.
3. In the event the professional liability insurer, for whatever reason, does not pay out, any liability is limited to the amount paid by the patient to our institute for the treatments and/or services in the case in connection with which the damage occurred, with a maximum of €750.
4. The institute is not liable for any damage to the patient resulting from a suspension of treatments and/or services by our institute if the suspension is the result of the patient's failure to pay our invoices on time.
5. Third parties cannot derive any rights from the content of the treatments and/or services provided. The patient indemnifies our institute against claims from third parties who claim to have suffered damage due to or in connection with treatments and/or services provided by our institute for the patient.
6. Our institute is not liable for any shortcomings in treatments and/or services provided by third parties in relation to the agreement.
12. Complaints and Disputes
1. If you have a complaint about our institute or practitioner, you should first discuss this with your practitioner or the complaints officer of our institute.
2. Your complaint will always be recorded. Our institute may use your complaint to further improve our services.
3. If you are not satisfied after speaking with our institute, you can contact the complaints officer of the NCA. Our institute is a member of the NCA and registered in the quality register of the Dutch Chiropractic Association (SCN).
4. If discussions with our institute and mediation by the NCA complaints officer do not lead to a resolution, a dispute may arise. A dispute resolution procedure is available through the NCA. The applicability of the dispute resolution procedure is established by signing the treatment agreement, to which these general terms and conditions apply.
5. All agreements between you and our institute, to which these general terms and conditions apply, are exclusively governed by Dutch law. The Dutch court within the district where our institute is located has exclusive jurisdiction to hear any dispute between our institute and you. However, our institute reserves the right to submit the dispute to the legally competent court.
13. Termination of the Treatment Agreement
1. The treatment agreement can be terminated at any time by mutual consent.
2. The treatment agreement terminates automatically:
- If it exclusively pertained to a specific examination and/or treatment, after its completion;
- In the case of death of the practitioner or the patient;
- In the event of other unforeseen circumstances, such as illness, disability, retirement, and the imposition of disciplinary measures (suspension or denial of treatment);
- If the patient no longer appreciates or deems the continuation of the treatment agreement necessary, they can unilaterally terminate it. The patient must inform our institute of this in a timely manner.
14. General Terms and Conditions
1. Deviations from these terms and conditions are only applicable if our institute has agreed to them in writing.
2. Our institute reserves the right to amend these general terms and conditions.
